Google und der Ritt auf der Kanonenkugel

Datenübermittlungen von personenbezogenen Daten ohne Rechtsgrundlage kommt immer mehr in den Brennpunkt behördlicher oder gerichtlicher Entscheidungen.

Am 20.01.2022 (AZ 3 O 17493/20) hat das LG München einen Schadenersatz zugesprochen. Der Grund war die Einbindung von Google Fonts in eine WebSite. Ein Nutzer der WebSite fühlte sich dadurch in seinen Grundrechten verletzt und hat geklagt. Das LG München hat in der Sache für den Nutzer entschieden.

Begründung:

Bei Verwendung von Google Fonts wird die IP-Adresse der Nutzer an Google LLC in den USA übermittelt. Eine IP-Adresse ist eine personenbezogene Information – unabhängig davon, ob die IP-Adresse eine statische oder dynamische ist. Die USA sind nach geltendem Datenschutzrecht ein unsicheres Drittland.

Ein berechtigtes Interesse als Rechtsgrundlage (Art. 6 Abs. 1 lit. f DSGVO) ist nicht anwendbar, da es keine Notwendigkeit gibt, Google Fonts einzusetzen. Somit ist als Rechtsgrundlage eine Einwilligung vorzusehen. Als Grundlage für einen Einwilligung bedarf es jedoch eine vorab Information. Diese ist ohne Fonts jedoch schwer darstellbar.

Aufgrund der unrechtmäßigen Datenübermittlung in ein unsicheres Drittland (USA) kam es zu einem immateriellen Schaden für den Nutzer wegen Verletzung seines informationellen Selbstbestimmungsrechts. Der damit einhergehende Kontrollverlust über die Verarbeiter seiner personenbezogenen Daten ist Auslöser für den Schaden.
